These Terms of Use set out the rules for accessing and using esquio.fr, the showcase site for Esquio's services. Accessing the site implies full acceptance of these terms.
The site is accessible free of charge, 24/7, except for maintenance interruptions or events beyond our control. Esquio does not guarantee continuous availability and cannot be held liable for temporary unavailability.
The site's content (text, visuals, code, brand identity) is protected by copyright. Any reproduction without authorisation is prohibited, except for client work explicitly shown with their consent.
By using a form on the site, you agree to provide accurate information and not to use it for fraudulent purposes, spam or unsolicited marketing. Esquio reserves the right to block any abusive use.
Esquio makes every effort to ensure the accuracy of information published on the site, without guaranteeing the complete absence of errors. The site may contain links to third-party sites for which Esquio is not responsible.
These Terms of Use are governed by French law.
These Terms of Sale apply to any service ordered from Esquio via esquio.fr, including the “Essentiel” plan (€100/month) and custom projects (bespoke quote). The free initial audit is not a paid service and is not subject to these Terms of Sale.
Every service starts with a prior discussion (form, email or call) to scope the need. For the Essentiel plan, the order is confirmed by the client's explicit agreement to the price and scope described on the site. For custom projects, a written quote is issued and work only begins after the client expressly accepts it.
The Essentiel plan is billed at €100/month, preceded by a one-off €100 setup fee charged at the start. Pricing for custom projects is stated in the accepted quote. Payment is made using the method indicated at the time of order (bank transfer or other agreed method). Late payment may result in suspension of the service after an unanswered reminder.
The Essentiel plan has no fixed term: the client may cancel at any time, with 30 days' notice given by email to contact@esquio.fr. Cancellation ends the maintenance and hosting included in the plan; the client is informed of how to retrieve their site before it is taken down.
Esquio commits to carrying out the service with care and in line with best practice, within reasonably announced timelines, keeping the client informed of progress.
The client agrees to provide, within a reasonable time, the content, access and approvals needed to carry out the service (text, visuals, access to an existing domain name, feedback on proposals). Any delay by the client in providing these may correspondingly delay delivery.
In accordance with Article L.221-18 of the French Consumer Code, a private (non-business) client has 14 days from the order date to withdraw without justification. If the client expressly requests that work start before this period ends, they acknowledge losing their right of withdrawal once the service is fully performed; in the event of partial performance before withdrawal, they will owe payment for the service already provided.
Esquio guarantees that the delivered site conforms to the specifications agreed with the client. Esquio cannot be held liable for damage resulting from misuse of the site by the client, changes made by a third party after delivery, or a failure attributable to a third-party provider (host, domain name, external service).
Unless otherwise agreed in writing, the client becomes the owner of the code and content specifically created for their site once the service is paid in full. Generic, reusable components developed by Esquio remain its property.
In the event of a dispute, a private client may use a consumer mediator free of charge, in accordance with Articles L.616-1 and R.616-1 of the French Consumer Code. Failing an amicable agreement, French courts shall have sole jurisdiction, subject to any mandatory legal provisions applicable to consumers.
These Terms of Sale are governed by French law.
